Contractors that receive federal funding for construction projects and employers in public works projects require numerous compliances. One of these is the Employee Rights Under the Davis-Bacon Act poster, which must be displayed on work sites at all times. The poster is available in English and Spanish.
The Davis-Bacon Act poster covers the following
(Source: U.S. Department of Labor – Wage and Hour Division)
- Prevailing Wage Rates
- Requirement and calculation of overtime pay
- Enforcement measures include:
o Withholding contract payments to ensure that workers receive their salary and overtime compensation,
o Imposing liquidation damages if overtime compensations are not met
o Contract termination and debarment of contractors from future federal contracts for up to three years,
o Civil or criminal prosecution, including fines and/or imprisonment, for falsifying certified payroll records or causing wage kickbacks
- Requirements for apprenticeship pay
- Contracting Officer contact information for reporting proper pay violations or obtaining information
- US DOL contact information
The regulations outlined in the Davis-Bacon Act Employee Rights poster will help to remind workers of their rights. They can also determine whether they are receiving adequate compensation and benefits; if not, they can seek assistance from the Wage and Hour Division.
Another important poster included is the minimum hourly rate poster. This states that a $15 per hour minimum hourly rate for all trades starts January 1, 2022. The third item that must always be presented on the job site is the wage determination for that specific construction project. All employees should have easy access to it. That way, they'll know what the minimal hourly fee is for doing specific types of labor on the project.
These Davis-Bacon and labor-related acts posters must be prominent and visible in the workplace, where employees can easily notice them.
